6th Circuit Upholds the Illegality Defense: What It Means for Cannabis Contracts NationwideOn September 10, 2026, the Sixth Circuit issued one of the most significant cannabis law decisions of the year — reversing a $31.8 million jury verdict and holding that federal courts cannot enforce marijuana supply contracts, even in states where cannabis is fully legal, because doing so would enforce conduct the Controlled Substances Act (CSA) makes criminal.In Hello Farms Licensing MI, LLC v. GR Vending MI, LLC, the court rejected arguments that the Rohrabacher-Farr Amendment's funding restrictions, or this year's DEA rescheduling of medical marijuana to Schedule III, changed the analysis — finding the federal illegality defense applies in full force to cannabis supply agreements. It's among the first major appellate rulings to squarely address this defense in the cannabis context, and it raises real questions for operators, investors, and counsel across the country:- What happens to existing supply and licensing agreements?
